01Acceptance of terms
These Terms & Conditions ("Terms") form a binding agreement between you ("you", "your", "the pharmacy", "the store") and PharmaSaathi ("we", "us", "our") governing your access to and use of the PharmaSaathi mobile application, web dashboard, admin panel, and related services (together, the "Service").
By creating an account, verifying your phone number with an OTP, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
If you are accepting these Terms on behalf of a pharmacy, shop, or business, you confirm that you are authorised to do so and that "you" refers to that business as well as yourself.
02The service
PharmaSaathi is a pharmacy management platform built for India's retail chemists. It includes, among other things:
- An offline-first Android app for billing, inventory, and expiry tracking
- Optional AI-assisted invoice scanning ("invoice OCR") to help digitise purchase bills
- A web dashboard for reports and store settings
- Notifications via push, SMS, WhatsApp and email for expiry, low stock and account alerts
We may add, change, or remove features from time to time. We'll try to give you reasonable notice of changes that materially reduce functionality you rely on, but routine improvements may be made without prior notice.
03Your account
You must provide a valid Indian mobile number and verify it via OTP to create an account. You're responsible for:
- Keeping your phone, OTP and device secure, and not sharing access with people outside your shop
- The accuracy of the store details, GSTIN, and other information you provide
- All activity that takes place under your account, including actions taken by staff you allow to use the app
If you suspect unauthorised access to your account, contact us immediately so we can help secure it.
04Plans & payments
PharmaSaathi offers a free plan and paid subscription plans ("Pro" and "Business"), with pricing displayed in Indian Rupees (₹) inclusive of applicable taxes unless stated otherwise. Paid plans are billed monthly in advance through Razorpay or other payment processors we may use.
- Subscriptions renew automatically each billing cycle unless cancelled before the renewal date
- You can cancel anytime from the app; cancellation takes effect at the end of the current billing period
- If a payment fails, your plan may be downgraded to the free plan until payment succeeds
- Refunds, where applicable, are processed back to the original payment method and may take a few business days to reflect
We may change subscription pricing for future billing cycles. If we do, we'll notify you in advance through the app, SMS, or email before the change applies to your account.
05Your data & content
You retain ownership of the data you enter into PharmaSaathi — including your inventory, sales records, customer details, distributor information, and uploaded documents or invoice images ("Your Data").
You grant us a limited licence to host, store, process, and transmit Your Data solely to provide and improve the Service, including using AI-based tools to read invoice images and extract structured information such as medicine names, quantities and prices. Details of how Your Data is handled are set out in our Privacy Policy.
If you stop using PharmaSaathi, Your Data is retained for a reasonable period in case you return, after which it may be deleted in line with our data retention practices.
06Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, including the sale of counterfeit, expired, or unauthorised pharmaceutical products
- Attempt to reverse-engineer, copy, resell, or white-label the app or admin systems without written permission
- Interfere with the Service's security, attempt to access other stores' data, or overload our systems (for example, through automated scraping)
- Upload content that is unlawful, defamatory, or infringes someone else's rights
07Regulatory compliance
You remain solely responsible for complying with all applicable laws and regulations governing the sale, storage, and dispensing of medicines in India, including (without limitation) the Drugs and Cosmetics Act, 1940, the Pharmacy Act, 1948, and any state-level drug licensing requirements (including holding a valid drug licence where required). Information generated by the app — including expiry alerts, OCR-extracted invoice data, and stock counts — is provided to help you manage your shop, but you should verify it against your physical stock and original documents before relying on it for regulatory or compliance purposes.
08Third-party services
To provide the Service, PharmaSaathi relies on third-party providers, including (but not limited to) payment processing (Razorpay), cloud storage for documents and images, SMS and WhatsApp messaging providers for OTPs and alerts, email delivery services, push notification services, and AI providers used for invoice scanning. Your use of features that rely on these providers is also subject to those providers' applicable terms, to the extent they apply to end users.
We choose providers carefully and require them to handle data responsibly, but we are not responsible for outages or issues that originate entirely from a third-party provider's systems.
09Intellectual property
The PharmaSaathi name, logo, app, website, admin panel, and underlying software are owned by us or our licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of this intellectual property to you. You're granted a limited, non-exclusive, non-transferable right to use the Service for your pharmacy's internal business operations.
10Suspension & termination
You may stop using the Service and close your account at any time from within the app, or by contacting us. We may suspend or terminate your access if:
- You materially breach these Terms and don't fix it after being notified
- We reasonably believe your account is being used fraudulently, abusively, or for unlawful purposes
- Required to do so by law, regulation, or a competent authority
Where reasonably possible, we'll give you advance notice and a chance to export Your Data before termination.
11Disclaimers & liability
The Service is provided on an "as is" and "as available" basis. While we work hard to keep PharmaSaathi accurate and reliable, we don't guarantee that the Service will be error-free, available without interruption, or that AI-based features such as invoice OCR will be 100% accurate — you should always review extracted data before confirming it.
To the maximum extent permitted by law, PharmaSaathi and its team are not liable for indirect, incidental, or consequential losses (such as lost profits or lost stock value) arising from your use of, or inability to use, the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the claim arose.
Nothing in these Terms limits any liability that cannot be limited under applicable Indian law.
12Governing law
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts located in India, in the city where PharmaSaathi is registered, unless otherwise required by applicable consumer protection law.
13Changes to these terms
We may update these Terms from time to time to reflect changes in the Service, legal requirements, or our practices. If we make material changes, we'll notify you through the app, SMS, or email before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
